These Terms of Service govern your use of the official online store at lightshowfactory.ca (the “Site”) and purchases from Andrew Witowsky, a Québec sole proprietor carrying on business under the declared business name L'usine de spectacles lumineux and its English-language version, Light Show Factory. In these Terms, “Light Show Factory,” “we,” “us,” and “our” refer to this merchant. The domain lightshowfactory.com redirects to the Site and is not a separate store or contracting party. By using the Site or placing an order, you agree to these Terms and the policies referenced below. If you are a consumer and a mandatory law provides greater protection, that law prevails.

2. Eligibility and accounts
You must have the legal capacity to enter into a purchase or act with the authorization of a parent, guardian, or authorized business representative. You are responsible for providing accurate, current, and complete account, billing, delivery, and contact information.
If you create an account, keep its credentials confidential and notify us promptly of suspected unauthorized use. We may take reasonable steps to protect the site, customers, and payment systems from fraud or misuse.
3. Product information and customer specifications
We aim to describe and display products accurately. Screen settings, photography, manufacturing tolerances, material batches, and handmade or custom production can cause reasonable visual or dimensional variation. A variation does not override an express specification or our obligation to supply a product that conforms to the contract, advertising, and applicable law.
Some products require technical knowledge, correct electrical design, weatherproofing, and installation appropriate to the application. Review the published voltage, current, polarity, controller compatibility, environmental rating, wiring, power-injection, fusing, and safety information before purchase and use. Follow applicable electrical and building requirements and use a qualified professional where appropriate.
For a custom, personalized, or cut-to-order product, you are responsible for reviewing the measurements, options, spelling, files, and other specifications you submit or approve. We remain responsible for producing the order according to the specifications we accepted.
4. Prices, currency, taxes, and charges
Unless clearly stated otherwise, prices are in Canadian dollars. Applicable taxes and delivery charges are displayed before you submit the order. Mandatory product charges within our control are included in the advertised price except taxes collected for a public authority and delivery charges that vary by the order and destination.
Discounts are applied according to their stated conditions. We will not add a charge to an accepted order without your express agreement or legal authority. A prospective price change does not alter the price of a contract already formed.
5. Reviewing and submitting an order
Before submitting an order, you can review and correct the products, quantities, options, delivery or pickup selection, address, and price summary. You are responsible for checking those details and for correcting any input error you can reasonably identify.
An automated receipt confirms that we received the order; it does not by itself expand any right to cancel a valid consumer contract. A contract is formed at the time determined by applicable law and the checkout and confirmation communications provided for the order. We will send a confirmation that can be retained or printed promptly and, where applicable law requires, no later than 15 days after contract formation. It will contain or reproduce the required contract information for the order.
Before contract formation, we may decline a proposed transaction for an objective reason such as failed payment authorization, reasonably suspected fraud, a legal restriction, or an inability to verify required order information. We may correct an obvious site error before contract formation and ask you to review the corrected offer.
After a contract has formed, we will not cancel the order or demand a higher price merely because inventory is unavailable or the displayed price was unintended. If an issue prevents fulfillment, we will contact you and provide the performance, substitute proposal, cancellation option, refund, or other remedy required or permitted by applicable law. We will not substitute a materially different product without your agreement.
6. Payment
Available payment methods are displayed at checkout. You confirm that you are authorized to use the selected method and authorize the disclosed charge. Payment may be authorized or collected when the order is placed.
Depending on the payment method, a charge or refund may appear under L'usine de spectacles lumineux or Light Show Factory. Both names identify the same merchant, Andrew Witowsky.
For a Québec consumer distance order paid before delivery, we will collect advance payment only by credit card unless a specific statutory exception applies. Unless a product page states otherwise, presale orders are paid in full at purchase. Our Presale Information page explains how the customer-facing process works.
7. Shipping, local pickup, and delivery
Our Shipping Policy forms part of these Terms and explains destinations, processing and production times, product categories, rates, free-shipping eligibility, local pickup, carriers, tracking, and delivery problems.
We remain responsible for taking reasonable steps to ensure an order is delivered as agreed, subject to applicable law. Responsibility does not automatically transfer to you merely because we handed a parcel to a carrier. You must provide a complete and accurate delivery address and cooperate reasonably with a delivery investigation.
8. Returns, refunds, cancellations, and exchanges
Our Return and Refund Policy forms part of these Terms. It governs voluntary change-of-mind returns, product exclusions, order cancellations, return costs, damaged or incorrect products, refunds, and exchanges.
Any final-sale designation applies only to voluntary change-of-mind returns. It does not remove a remedy for damage, defect, non-conformity, non-delivery, or another mandatory right.
9. Presales and made-to-order products
Our Presale Information page provides a plain-language overview of how presales work. The product page and order confirmation state the applicable shipment or delivery window. An order containing presale, backordered, made-to-order, and in-stock items may be held until all items are ready, as explained in these Terms and our Shipping and Return and Refund policies.
A change-of-mind cancellation for a custom or made-to-order product may be unavailable after order-specific production or preparation begins. This does not limit a cancellation right or remedy provided by law.
10. Warranties and product support
A product may have a Light Show Factory or manufacturer conventional warranty when that warranty is expressly disclosed before purchase. The written product-specific terms identify the warrantor, duration, coverage, exclusions, remedies, and claim process.
For an approved claim involving a pixel product covered by an advertised Light Show Factory warranty, our normal remedy is replacement rather than repair. When a controller has an advertised manufacturer warranty, we will help you access the manufacturer's claim process.
There is no blanket time-limited conventional warranty for a product when none is advertised. Every product nevertheless remains covered by all mandatory legal warranties, and a manufacturer warranty does not remove any responsibility applicable law places on us as the seller.
11. Acceptable use
You may not use the site or its content to:
- break the law, commit fraud, impersonate another person, or infringe another person's rights;
- introduce malware or harmful code, interfere with site security or operation, or attempt unauthorized access;
- collect personal information unlawfully;
- send deceptive, abusive, or unsolicited communications through the site; or
- reproduce or exploit protected content except as permitted by these Terms, a product-specific licence, or law.
We may restrict access when reasonably necessary to stop conduct of this kind. We will not use this section to prevent an honest review, lawful complaint, or exercise of a consumer right.
12. Intellectual property and product licences
Site content—including text, photographs, graphics, videos, branding, and software—is owned by or licensed to Light Show Factory and is protected by applicable law. Third-party names, marks, product designs, files, and content remain the property of their respective owners or licensors.
You may use the site for personal or internal business shopping purposes. You may not copy, publish, sell, redistribute, or commercially exploit site content without permission, except where law allows it.
A product, design file, xLights model, download, or other digital asset may have a product-specific licence allowing uses that these general Terms do not describe. That product-specific licence controls for the licensed asset. Do not redistribute, resell, or use a licensed file with competing products when the applicable licence prohibits it.
13. Reviews and other submitted content
You retain ownership of content you submit, such as a review, photograph, or project image. You grant Light Show Factory a non-exclusive, worldwide, royalty-free licence to host, reproduce, adapt for formatting, display, and share that content to operate and promote the store and its products, subject to our Privacy Policy and applicable law.
You confirm that you have the rights needed to submit the content and that it is not unlawful, deceptive, defamatory, privacy-invasive, or infringing. We may moderate or remove content for those reasons. We do not prohibit or penalize honest reviews or lawful consumer communications.
14. Third-party services and links
The site may use or link to services provided by Shopify, payment providers, carriers, mapping services, social platforms, or other third parties. Their services may be governed by their own terms and privacy practices. We are not responsible for independent third-party content or conduct outside our reasonable control, but this section does not remove any responsibility applicable law places on us for your order.
15. Privacy
Our Shopify-managed Privacy Policy explains how personal information is collected, used, disclosed, and protected. It forms part of your use of the site. The Privacy Policy is updated separately from these Terms.
16. Site availability, disclaimers, and responsibility
We take reasonable care in operating the site, but do not promise that access will always be uninterrupted or that every non-material site error will be corrected immediately. We may maintain, secure, or update the site without notice where reasonably necessary.
Products remain subject to all descriptions, express warranties, and mandatory legal warranties. Our responsibility for an order and your remedies are governed by the contract and applicable law.
To the extent permitted by law, Light Show Factory is not responsible to the extent a loss is caused solely by a customer's misuse, unsafe or incompatible installation, unauthorized modification, inaccurate customer specification, or unlawful conduct, or solely by an independent event outside our reasonable control. This does not release us from the consequences of our own acts or those of our representatives. Nothing in these Terms excludes or limits liability for intentional or gross fault, bodily or moral injury, a mandatory consumer right, or any other obligation that cannot lawfully be excluded or limited.
17. Governing law and disputes
Please contact us first so we can try to resolve a concern. These Terms are governed by the laws of Québec and the applicable federal laws of Canada, without depriving a consumer of mandatory protections or any court jurisdiction or venue available under the law of the place where the consumer resides.
These Terms do not require pre-dispute arbitration, waive a right to bring or participate in a class proceeding, or prevent access to a competent court or consumer-protection authority where the law provides that access.
18. Changes to these Terms
We may update these Terms prospectively by posting a revised version and effective date. A revision does not retroactively alter a contract already formed. The Terms and policies in effect when an order is formed govern that order, unless the parties agree otherwise or mandatory law requires a different result.
19. Severability and no waiver
If a provision is unlawful or unenforceable, it will be read down or severed to the minimum extent necessary, and the remaining provisions continue to apply. A delay in enforcing a provision is not a waiver of it or of any later right.
